Terms of Service

1. Acceptance

By creating an account or using Determinari products — including HVAC-R Diagnostic Pro and SCSH Diagnostic Tool (each, the "Service") — you agree to be bound by these Terms of Service. If you are using a Service on behalf of a company or shop, you represent that you have authority to bind that organization to these terms.

2. Professional Use

The Services are intended for use by licensed HVAC/R professionals as an aid to diagnosis, record-keeping, and reporting. The diagnostic outputs, pressure-temperature lookups, and fault rankings are provided as decision support only and do not replace the trained judgment of a qualified technician. You are responsible for complying with all applicable laws and refrigerant-handling regulations (including EPA 608 in the United States and any equivalent local rules).

3. Subscriptions and Billing

Paid plans are billed in advance on a monthly or annual basis through Stripe. Where a Service charges per seat, seat counts are calculated from the number of active technicians and managers in your shop. Subscriptions renew automatically until cancelled. Refunds are handled on a case-by-case basis; contact us for assistance.

4. Account Responsibility

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately if you suspect unauthorized access.

5. Acceptable Use

You agree not to misuse the Services, including by attempting to gain unauthorized access, reverse engineering the application, scraping data from other shops, or using a Service to violate any law or third-party right.

6. Intellectual Property

The Services, including their diagnostic engines, refrigerant data tables, design, and source code, are owned by us and our licensors. The data you enter (jobs, diagnostics, reports) remains yours, and you grant us a limited license to host and process it so we can operate the Services for you.

7. Warranties and Disclaimers

The Services are provided on an "as is" and "as available" basis. We disclaim all implied warranties to the maximum extent permitted by law, including merchantability and fitness for a particular purpose. We do not warrant that diagnostic results will be free of error in every operating condition.

8. Limitation of Liability

To the maximum extent permitted by law, our aggregate liability arising out of or relating to the Services is limited to the amounts you paid us in the twelve months preceding the claim. We are not liable for indirect, incidental, consequential, or special damages.

9. Termination

You may cancel your subscription at any time from the Billing Portal. We may suspend or terminate accounts that violate these terms or that pose a security risk to other users.

10. Changes

We may update these terms from time to time. Material changes will be communicated to account owners, and continued use of a Service after the effective date constitutes acceptance of the revised terms.
